A U.S. appeals court has delayed a lawsuit against the EPA over its newly proposed emissions rules for new coal-fired power plants, Platts reports. The court will in July hear motions to combine the case with various lawsuits against the agency’s New Source Rule. Platts notes that the court also recently delayed oral arguments in a lawsuit over the Obama Administration’s Clean Power Plan from June until September.
The Supreme Court in February voted to block the Clean Power Plan until the lower court can hear all challenges. The decision likely leaves the fate of the plan in the hands of the next president given that the Supreme Court’s next term begins in October.
