The Texas Supreme Court today ruled in favor of a group of refiners and petrochemical producers in a lawsuit against the city of Houston over local air pollution laws.
Via the Washington Post, the city in 2008 passed ordinances that required companies to pay registration fees based on the number and types of pollution at their sites and allowed for criminal prosecution without oversight from the Texas Commission on Environmental Quality. The court ruled 8-1 that the ordinances were inconsistent with the statewide regulatory regime established by the Texas legislature.
